ISLAMABAD: The Supreme Court on Friday restrained the judges, who had taken oath under the annulled Provisional Constitutional Order (PCO) 2007 and now facing contempt proceedings, from passing any order against the sitting judges of the apex Court or the members of a bench that had passed an order on February 2 over their appeals. The SC reminded Justice Hasnat Ahmed Khan, Justice Syed Shabbar Rizvi, Justice Hamid Ali Shah and Justice Syed Sajjad Hussain Shah of Lahore High Court, Justice Mrs Yasmeen Abbasi of Sindh High Court, Justice Jehanzeb Rahim Khan of Peshawar High Court and Justice Sayed Zahid Hussain of the apex Court, that they “shall not pass any such order against the members of the bench or the judges of the Supreme Court and if any such order is passed by them, the same shall have no legal or binding effect upon this Court as well as any other functionaries in the country and shall be deemed to be an order which is not in existence at all.” The SC bench held that it was passing an order “to preserve and protect the dignity and respect of the judges of the bench seized with the matter as well as other judges of this court, and in order to ensure that system of administration of justice and honour of this institution including High Courts and District Courts are preserved.” The special bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Javed Iqbal, Justice Mian Shakirullah Jan, Justice Tassaduq Hussain Jillani, Justice Mian Saqib Nisar, Justice Sarmad Jalal Osmani and Justice Amir Hani Muslim issued the order after hearing the arguments of counsel for Justice Hasnat Ahmed Khan and Justice Syed Shabbar Raza Rizvi, two dysfunctional judges of the Lahore High Court. The bench order came in the backdrop of Thursday’’s unfolding events in which Justice Jehanzeb Rahim of PHC, issued notice to four judges of the apex Court including Justice Mahmood Akhtar Shahid Siddiqui, Justice Jawwad S. Khawja, Justice Khilji Arif Hussain and Justice Tariq Parvez, who had rejected his appeal against contempt proceedings. The bench noted that according to a note put up by the Registrar, Justice Jehanzeb Rahim had passed an order on February 17 in his chambers to issue contempt notices to four judges of the Supreme Court hearing his plea, but the matter was taken up by the Chief Justice Peshawar High Court on administrative side and said that the order was passed in vacuum. Besides, a three-member bench of the PHC set that order aside. The bench observed in its order that certain persons whose cases were pending instead obeying orders of the Court started making attempts to undermine the authority of Supreme Court and its judges by issuing notice. The bench also directed counsel of other dysfunctional judges to submit fresh applications to be fixed before this bench on February 21. At the outset of proceedings, Dr Abdul Basit, counsel for two judges, said that February 21 was fixed by the four-Judge bench for framing of contempt charges against his client on the basis of a short order. He said unless there was a detailed judgement with reasons, the proceedings could not be conducted. He said “If such a trial is started under such circumstances, it will undermine their fundamental rights as enshrined in Article 10A which guarantees holding of fair trial.” He said that in absence of detailed reasons, the present proceedings would amount to ”holding of mistrial”.
